These Terms and Conditions ("Terms") govern your use of the in/out: Calorie Companion mobile application ("App") and any associated services provided by in/out ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.
1. Pre-Registration Reward
Users who pre-register for in/out on the Google Play Store prior to the App's official release date are eligible to receive in/out Pro as a complimentary one-time reward. The following conditions apply:
- Eligibility: You must have pre-registered via Google Play Store before the App's public launch date.
- Delivery: The reward is automatically applied to your account upon your first sign-in after the App launches. No purchase or redemption code is required.
- Limit: One reward per Google account. The reward is non-transferable and has no cash value.
- Expiration: The reward must be claimed (first app launch and sign-in) within 60 days of the App's official release. Unclaimed rewards expire after this window.
- Scope: in/out Pro unlocks all premium features available at the time of launch, including advanced analytics, unlimited AI food logging, all themes, and priority support.
We reserve the right to modify, suspend, or cancel the pre-registration reward program at any time, with or without notice, in the event of fraud, technical issues, or circumstances beyond our control. Google Play pre-registration participation is governed by Google's own terms and policies.
2. Acceptance of Terms
By using in/out, you confirm that you are at least 13 years of age, have read and understood these Terms, and agree to be bound by them. If you do not agree, you must not use the App.
3. Use of the App
in/out is a personal nutrition and fitness tracking application. You agree to use the App only for lawful purposes and in a manner consistent with all applicable laws. You must not:
- Use the App to harm, harass, or deceive other users
- Attempt to reverse-engineer, decompile, or extract source code from the App
- Use automated tools to scrape, crawl, or interact with the App at scale
- Share your account credentials with others
4. Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at inoutsupport@proton.me if you suspect unauthorized access.
5. Health Disclaimer
in/out is not a medical application and does not provide medical advice. Calorie goals, BMR calculations, and nutritional estimates are provided for informational purposes only. Always consult a qualified healthcare professional before making significant changes to your diet or exercise routine. We are not liable for any health outcomes resulting from your use of the App.
6. Third-Party Fitness Integrations
in/out allows you to connect third-party fitness and health services, including Fitbit, Strava, Withings, Oura Ring, WHOOP, Garmin, and Samsung Health, to import activity, sleep, heart rate, weight, and step data into the App. By connecting any such service, you agree to the following:
- Authorization: You grant in/out permission to access your fitness data from the connected service via that service's official API, using only the scopes you explicitly authorize during the OAuth flow.
- Purpose limitation: Data retrieved from third-party fitness services is used solely to populate your personal in/out dashboard (step count, sleep, heart rate, calorie burn). It is never sold, rented, or transferred to third parties, and is never used for advertising, marketing profiling, or any purpose other than providing in/out's features to you.
- No unauthorized re-sharing: We do not share, transfer, or disclose data obtained from Fitbit or any connected fitness service to any external party, except as required by law or as part of the in/out service operation (e.g., secure storage in your personal Supabase account).
- Minimum data access: We request only the minimum scopes necessary to display relevant data in your dashboard. We do not request access to data we do not display in the App.
- Revocation: You may disconnect any linked service at any time from Settings → Connected Services → Unlink. Unlinking removes the stored access token from your device immediately. Any data already imported into your in/out account is governed by our data retention policy (Section 10).
- Third-party terms: Your use of connected services is also governed by that service's own terms of service and privacy policy. In the case of Fitbit, this includes the Fitbit Terms of Service and Fitbit Privacy Policy.
We reserve the right to suspend or remove third-party integrations at any time, including in response to changes in a third party's API terms, deprecation, or other circumstances beyond our control.
7. AI Features
in/out uses AI-powered features (food recognition, voice logging, calorie analysis) powered by the Anthropic Claude API. AI responses are estimates and may not be 100% accurate. You should verify nutritional information from authoritative sources when precision is critical.
8. In-App Purchases & Subscriptions
in/out Pro may be available as a one-time purchase or subscription via Google Play. All purchases are subject to Google Play's billing policies. We do not process payment information directly — all transactions are handled by Google. Subscription renewals, cancellations, and refunds are managed through your Google Play account settings.
9. Intellectual Property
All content, design, code, logos, and branding within in/out are owned by us and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.
10. Limitation of Liability
To the fullest extent permitted by law, in/out and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of health outcomes, or service interruptions.
11. Termination
We reserve the right to suspend or terminate your access to the App at any time for violation of these Terms. You may delete your account at any time from Settings → Account → Delete Account. Upon account deletion, all personal data is removed within 30 days.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via in-app notification or by updating the "Last updated" date above. Continued use of the App after any changes constitutes your acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with applicable law.
