Terms & Conditions

These Terms and Conditions ("Terms") govern your use of the in/out: Calorie Companion mobile application ("App") and any associated services provided by in/out ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Pre-Registration Reward

Users who pre-register for in/out on the Google Play Store prior to the App's official release date are eligible to receive in/out Pro as a complimentary one-time reward. The following conditions apply:

• Eligibility: You must have pre-registered via Google Play Store before the App's public launch date.
• Delivery: The reward is automatically applied to your account upon your first sign-in after the App launches. No purchase or redemption code is required.
• Limit: One reward per Google account. The reward is non-transferable and has no cash value.
• Expiration: The reward must be claimed (first app launch and sign-in) within 60 days of the App's official release. Unclaimed rewards expire after this window.
• Scope: in/out Pro unlocks all premium features available at the time of launch, including advanced analytics, unlimited AI food logging, all themes, and priority support.

We reserve the right to modify, suspend, or cancel the pre-registration reward program at any time, with or without notice, in the event of fraud, technical issues, or circumstances beyond our control. Google Play pre-registration participation is governed by Google's own terms and policies.

2. Acceptance of Terms

By using in/out, you confirm that you are at least 13 years of age, have read and understood these Terms, and agree to be bound by them. If you do not agree, you must not use the App.

3. Use of the App

in/out is a personal nutrition and fitness tracking application with optional community and coaching features. You agree to use the App only for lawful purposes and in a manner consistent with all applicable laws. You must not:

• Use the App to harm, harass, threaten, deceive, or impersonate other users
• Post or share content that is unlawful, hateful, harassing, sexually explicit, defamatory, or misleading
• Attempt to reverse-engineer, decompile, or extract source code from the App
• Use automated tools to scrape, crawl, or interact with the App at scale
• Interfere with, disrupt, or attempt to gain unauthorized access to the App, its servers, or other users' accounts
• Share your account credentials with others

4. User Content & Community Conduct

in/out includes community features such as a public feed, forums, accountability pods, challenges, leagues, and shared recipes ("User Content"). You retain ownership of the User Content you create. By posting User Content, you grant in/out a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and distribute that content within the App for the purpose of operating and improving the service.

• Responsibility: You are solely responsible for the User Content you post and represent that you have the rights to share it.
• Visibility: Content you post may be visible to other users, and public posts may be visible to anyone using the App. Do not post sensitive personal information you do not wish to share.
• Moderation: We may review, moderate, or remove any content, and suspend or terminate accounts, that violate these Terms or that we consider harmful. Some content is screened by automated safety filters.
• Reporting: If you encounter content that violates these Terms, please report it to inoutsupport@proton.me.

5. Coaching Features

in/out allows users to connect as coaches and clients and to use an automated "AI Coach." The following applies:

• Independent users: Coaches are independent users of the App, not employees or agents of in/out. We do not verify coach credentials and do not endorse, guarantee, or assume responsibility for any coach or the guidance they provide.
• Not professional advice: Coaching and AI Coach content is general wellness and motivational guidance only and is not professional medical, dietary, or psychological advice.
• Data sharing: If you enter a coaching relationship, you authorize in/out to share the agreed, limited set of your data (such as selected logs and progress trends) with that coach. You choose whom you share with, and you may end the relationship at any time.
• Paid sessions: Paid coaching sessions are not currently offered. If paid coaching is introduced, it will be subject to additional terms presented at that time.

6. Virtual Items, Rewards & Referrals

The App includes gamification and promotional features such as XP, levels, badges, streaks, streak-freeze tokens, league standings, and referral rewards. These items:

• Have no monetary value, are not your property, and cannot be sold, transferred, or redeemed for cash.
• May be adjusted, reset, expired, or removed at our discretion, including to correct errors or maintain fair play.
• In the case of referral rewards and other promotions, may be changed or cancelled at any time, and may be revoked where obtained through fraud, self-referral, automated means, or other abuse.

7. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at inoutsupport@proton.me if you suspect unauthorized access.

8. Health & Wellbeing Disclaimer

in/out is not a medical application and does not provide medical advice. Calorie goals, BMR calculations, nutritional estimates, AI outputs, and coaching content are provided for informational purposes only. Always consult a qualified healthcare professional before making significant changes to your diet or exercise routine. If you have, or are at risk of, an eating disorder or any other medical condition, please consult a qualified professional before using calorie-, weight-, or fasting-related features. We are not liable for any health outcomes resulting from your use of the App.

9. Third-Party Fitness Integrations

in/out allows you to connect third-party fitness and health services, including Fitbit, Strava, Withings, Oura Ring, WHOOP, Garmin, and Samsung Health, to import activity, sleep, heart rate, weight, and step data into the App. By connecting any such service, you agree to the following:

• Authorization: You grant in/out permission to access your fitness data from the connected service via that service's official API, using only the scopes you explicitly authorize during the OAuth flow.
• Purpose limitation: Data retrieved from third-party fitness services is used solely to populate your personal in/out dashboard (step count, sleep, heart rate, calorie burn). It is never sold, rented, or transferred to third parties, and is never used for advertising, marketing profiling, or any purpose other than providing in/out's features to you.
• No unauthorized re-sharing: We do not share, transfer, or disclose data obtained from Fitbit or any connected fitness service to any external party, except as required by law or as part of the in/out service operation (e.g., secure storage in your personal Supabase account).
• Minimum data access: We request only the minimum scopes necessary to display relevant data in your dashboard. We do not request access to data we do not display in the App.
• Revocation: You may disconnect any linked service at any time from Settings → Connected Services → Unlink. Unlinking removes the stored access token from your device immediately. Any data already imported into your in/out account is governed by our data retention policy.
• Third-party terms: Your use of connected services is also governed by that service's own terms of service and privacy policy. In the case of Fitbit, this includes the Fitbit Terms of Service and Fitbit Privacy Policy.

We reserve the right to suspend or remove third-party integrations at any time, including in response to changes in a third party's API terms, deprecation, or other circumstances beyond our control.

10. AI Features

in/out uses AI-powered features (food recognition, voice logging, calorie analysis, and the AI Coach) powered by the Anthropic Claude API. AI responses are estimates and may not be 100% accurate. You should verify nutritional information from authoritative sources when precision is critical, and you should not rely on AI output as professional advice.

11. In-App Purchases & Subscriptions

in/out Pro may be available as a one-time purchase or subscription via Google Play. All purchases are subject to Google Play's billing policies. We do not process payment information directly — all transactions are handled by Google. Subscription renewals, cancellations, and refunds are managed through your Google Play account settings.

12. Intellectual Property

All content, design, code, logos, and branding within in/out (excluding User Content you create) are owned by us and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.

13. Limitation of Liability

To the fullest extent permitted by law, in/out and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of health outcomes, conduct of other users, or service interruptions. The App is provided "as is" and "as available" without warranties of any kind.

14. Termination

We reserve the right to suspend or terminate your access to the App at any time for violation of these Terms. You may delete your account at any time from Settings → Delete Account in the App. Upon account deletion, all personal data is removed within 30 days, as described in our Privacy Policy and on our Delete Your Account page.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via in-app notification or by updating the "Last updated" date above. Continued use of the App after any changes constitutes your acceptance of the revised Terms.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Oregon, United States, without regard to its conflict-of-law principles. Any dispute arising from these Terms or your use of the App shall be resolved through binding arbitration conducted in Oregon, in accordance with applicable law. To the extent permitted by law, you and in/out each waive the right to a jury trial and the right to participate in a class, collective, or representative action; disputes must be brought on an individual basis.
